Terms of Sale

Applicable Law
The present General Terms of Sale are subject to The Consumer Protection (Distance Selling) Regulations 2000.

We accept orders on this website from the UK only. For other countries, please visit www.damartex.com. You must be 18 or over.

Acceptance of your order
When you have submitted your online order, and providing you have given us a valid email address, you will receive a confirmation email to acknowledge receipt of your order. Our acceptance of your order, and the conclusion of the contract will only occur when we dispatch your goods. We will not be held responsible for delays to your delivery that are out of our control, although we will do our utmost to liaise with any 3rd party carriers to resolve any issues as soon as is possible.

Right to Cancel
Under The Consumer Protection (Distance Selling) Regulations 2000, you have the right to cancel any items ordered (excluding personalised items) within 7 working days (Monday - Saturday) from the day after you receive your goods. Any monies paid, including initial postage and packing costs, for the order will be refunded within 30 days of cancellation. If you exercise this right to cancel you must immediately return the relevant items to us at your own cost.

The Damart Personal Account
Here's how the Damart Personal Account works:

• You can use your Damart Personal Account at any time and spread your payments for up to 20 months, simply select the Personal Account option when ordering.
• A minimum payment of one-twentieth of the cash price of goods bought or £5, (whichever is greater,) plus service charge will be due from you when a statement is sent to you typically every 28 days. You can then choose to pay in full or by regular 4 weekly instalments. After your first statement the service charge of 2.5 pence in the pound is added to the balance outstanding when your statement is produced. (Typical APR 34.2% variable). For each statement after the first, the minimum service charge on an outstanding balance will be no less than 50 pence per statement. We reserve the right to vary the duration, service charge and the minimum payment. Should this be necessary we will give you at least 28 days notice. To calculate your approximate repayment simply divide the cash price of any item by 20, e.g. Goods costing £100 could be paid for in 20 instalments of £5 plus service charges. If you repay more than the minimum payment the service charge will be reduced accordingly. Written quotations are available on request. Any customers over 18 are welcome to use the Personal account facility but we reserve the right to refuse credit orders and we will consult the files of a credit reference agency who will record the search. We share information about you and the conduct of your account with them, with other lenders and relevant third parties. Information about you and other members of your household and those with whom you are financially linked will be used to verify your identity and for credit assessment of you and them. We also use your information including shopping habits to open and run your credit account including payment recovery, fraud prevention and debtor tracing.
• Should you fail to make a payment or pay less than the minimum amount due and we or someone acting for us have to remind you we reserve the right to make a reasonable administration charge to cover our costs. This is currently £12 but is subject to change.
• We reserve the right to restrict or refuse credit orders.
• Full payment details are confirmed to you prior to you confirming your order, including postage and packing charges.
• If using your Personal Account you can pay by card, cheque or postal order.

GRAND PRIZE DRAW RULES 2010
This is the Damartex UK Limited Group Grand Prize Draw 2010 and the prizes offered are common to other similar promotions offered by this Company and others within the Damartex UK Limited Group during the same period of validity. Entry into the Grand Prize Draw is not conditional upon the purchase of goods. Entries into the Grand Prize Draw can be made between 1 January 2010 and 31st December 2010 by any of the following methods: 1) Post - Simply tick the "Yes" box on your Promotional Order Form and return it in the enclosed envelope or to any Damart UK Shop. Written entries must be on an original Promotional Order Form photocopies will not be accepted. Damartex UK Limited accepts no responsibility for entries lost or damaged in the post. Proof of posting will not be accepted as proof of receipt. 2) Telephone - Quote the relevant Privilege code when contacting the Customer Services Team. The Privilege code is clearly identified on each Promotional Order Form. 3) Internet - Tick the relevant box on our website and quote the relevant Privilege code. The mailing code is clearly identified on each Promotional Order Form. All entries must be received and validated by the closing date of 31st December 2010. The draw consists of one prize of £40,000 cash to be awarded to the first name drawn at random. In addition if the winner of the £40,000 has quoted and returned a Privilege code within 14 working days of receipt of a qualifying promotion, they will be awarded an Early Reply Bonus of £10,000. There is no choice of prizes and no alternatives. The Prize Draw Winner will be notified approximately 30 days after the closing date. The name and home town of the Prize Draw Winner will be available on request by sending a stamped addressed envelope to: Grand Prize Draw Winner, Damartex UK Limited, Bowling Green Mills, Lime Street, Bingley, West Yorkshire, BD97 1AD. Damartex UK Limited may invite the Prize Draw Winner to feature in publicity, subsequent promotions and advertising material. Damartex UK Limited may not publicise any details of the Prize Draw Winner without the prior written consent of that person, save as required by law. All entrants must be residents of the United Kingdom and must be aged 18 or over. Persons involved in the promotion and execution of the draw, employees of Damartex UK Limited, their agents and their relatives are not eligible to enter the Grand Prize Draw. Prizes are not transferable. No correspondence will be entered into concerning the draw.

£1,000 POCKET THE CHEQUE PRIZE DRAW RULES
This is a Damartex UK Limited Group prize draw and the prizes offered are common to other similar promotions offered by this Company and others within the Damartex UK Limited Group during the same period of validity. Entry into the Prize Draw is not conditional upon the purchase of goods. Entries into the Prize Draw can be made between 1 January 2010 and 30th June 2010 by any of the following methods: 1) Post - Simply tick the "Yes" box on your Promotional Order Form and return it in the enclosed envelope. Written entries must be on an original Promotional Order Form as photocopies will not be accepted. Damartex UK Limited accepts no responsibility for entries lost or damaged in the post. Proof of posting will not be accepted as proof of receipt. 2) Telephone - Quote the relevant privilege code when contacting the Customer Services Team. 3) Internet - Quote the relevant privilege code in your basket when you place your order. Please note the privilege code is clearly identified on each Promotional Order Form. All entries must be received and validated by the closing date of 31st December 2010. The draw consists of five prizes of £1,000 cash to be awarded to the first five names drawn at random. There is no choice of prizes and no alternatives. Each winner who has made a purchase will, if possible, receive a £1,000 specimen cheque in their package or confirmation by post if the package has been mailed. Winners who have not made a purchase will receive written confirmation by post of their win. The original cheques will then be sent by post once all winners have been informed. The name and home town of the Prize Draw Winners will be available on request, 30 days after the closing date, by sending a stamped addressed envelope to: Prize Draw Winners, Damartex UK Limited, Bowling Green Mills, Lime Street, Bingley, West Yorkshire, BD97 1AD.
